Terms and conditions

1. Who we are

Which Niche? ("we", "us", "our") is a trading name of Jonathan Steele, a sole trader based in the United Kingdom. When you use the Which Niche? website or app (the "Service"), your contract is with Jonathan Steele. You can contact us at hello@whichniche.app.

2. Accepting these terms

By creating an account or continuing to use the Service, you agree to these terms. If you don't agree, please don't use the Service. You must be at least 18 years old to buy a plan.

3. What the Service is

Which Niche? analyses publicly available product reviews and complaints and presents business opportunities as "cards" and "dossiers". Cards are prepared with the help of automated tools, including artificial intelligence, and reviewed by us before publication.

4. Not advice, and no guarantee of results

Everything in the Service is general information for research and education. It is not financial, investment, legal, tax or professional business advice. We do not promise that any idea will make money, and nothing we publish is an income claim. Check anything important yourself and take professional advice before committing money.

5. Accuracy of AI-assisted content

We work hard to make cards accurate and to link the evidence behind them, but automated analysis can make mistakes. Complaint counts, summaries and scores may be incomplete, out of date or wrong. You are responsible for how you use the content and for any decisions you make based on it. If you spot an error, tell us and we'll correct it.

6. Exposure caps and private claims

Each card is shown to at most 25 members before it leaves the public feed. A private claim (£29) hides a card from new viewers for 90 days from purchase. Members who saw the card before your claim may still see it. A claim gives you a head start, not ownership: the complaints behind every card are public, and anyone may act on the same problem independently.

7. Your account and acceptable use

Keep your login details secure; you're responsible for activity on your account. You must not:

8. Intellectual property

We own the Service, including its software, design, cards, dossiers and scores, or license them from others. While you're a member, we give you a personal, non-transferable licence to use cards and dossiers to research and start your own business. Quotes from public reviews remain the property of their authors and are used briefly, with links, for commentary and analysis. If you believe content in the Service infringes your rights, email us and we'll review and, where appropriate, remove it promptly.

9. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms also apply to your purchase.

10. Availability

We aim to keep the Service running smoothly, but we don't guarantee it will be uninterrupted or error-free. We may change, add or remove features, and we may pause the Service for maintenance.

11. Suspension and termination

We may suspend or close your account if you seriously or repeatedly breach these terms, don't pay, or create a security or fraud risk. You can close your account at any time by emailing us.

12. Our liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Otherwise, we are not liable for business losses, such as lost profits, revenue or opportunity, or for losses that weren't foreseeable. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. If you are a consumer, you also have legal rights that these terms don't affect.

13. Changes to these terms

We may update these terms. If a change materially affects you, we'll email you at least 14 days before it takes effect.

14. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you keep the protection of your local consumer law and may bring proceedings where you live.
